1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the PROPLIVEX platform and website (proplivex.com), operated by PropertyIQ LLC d/b/a PROPLIVEX, a Florida limited liability company (“PROPLIVEX,” “we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Description of Service

PROPLIVEX is an informational compliance monitoring platform designed to help Florida property owners track HOA and condominium compliance requirements under Florida law, including HB 913, SB 4-D, and HB 1203. Our service provides:

• Compliance deadline tracking and monitoring alerts
• Information about Florida HOA and condo regulations
• Property compliance status overviews
• Document and resource references
• Professional referrals (Professional plan; as available)

3. Not Legal Advice

IMPORTANT: PROPLIVEX is an informational platform only and does not provide legal advice. The information provided through our platform does not constitute legal advice and should not be relied upon as such. PropertyIQ LLC d/b/a PROPLIVEX is not a law firm and does not provide legal services. No attorney-client relationship is created by your use of this platform.

For legal advice regarding HOA, condominium, or property compliance matters under Florida law, you must consult a licensed Florida attorney. Compliance requirements change — always verify current regulations with the appropriate Florida government authority.

4. Subscription Plans and Payment

Free Plan: Basic compliance information access at no cost.

Basic Plan: $29/month or $278/year. Includes monitoring for 1 property, deadline alerts, and compliance summaries.

Professional Plan: $49/month or $470/year. Includes monitoring for up to 3 properties, plus premium tools (dispute letter templates, special assessment calculator, pre-purchase risk evaluator, professional referrals) as those features become available.

All paid plans are billed through Stripe. Annual plans are billed upfront. Prices are subject to change with 30 days notice to active subscribers.

5. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access until the end of your current billing period. We do not offer prorated refunds for partial billing periods. If you believe you were charged in error, contact us within 14 days of the charge for review.

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to reverse engineer, scrape, or copy our platform or data
• Interfere with or disrupt the platform’s operation
• Misrepresent your identity or affiliation
• Use the platform to provide legal advice to third parties
• Resell or redistribute our services without written authorization

8. Accuracy of Information

PROPLIVEX strives to provide accurate and up-to-date compliance information. However, Florida laws and regulations change frequently. We make no warranty that the information on our platform is current, complete, or accurate. You are solely responsible for verifying any compliance information with the appropriate authorities before taking action.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, PropertyIQ LLC d/b/a PROPLIVEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Intellectual Property

All content, features, and functionality of the PROPLIVEX platform — including but not limited to text, graphics, logos, software, and data compilations — are owned by PropertyIQ LLC d/b/a PROPLIVEX and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without written permission.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the platform shall be resolved in the state or federal courts located in Broward County, Florida. You consent to the personal jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email and by posting the updated Terms on this page. Your continued use of the platform after the effective date of changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the platform at any time, with or without cause, with or without notice. Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PropertyIQ LLC d/b/a PROPLIVEX regarding your use of the platform and supersede all prior agreements.
